Commencing an Arbitration
under the LIAC-BBA Rules

An arbitration under the LIAC-BBA rules is commenced by filing a Request for Arbitration to the LIAC-BBA.

The arbitration shall be deemed to have commenced on the date on which the Request for Arbitration is received by the LIAC-BBA.

1- The Request for Arbitration shall contain the following information:

a- The parties’ names, nationalities, addresses and other contact details as well as their representatives’ names, nationalities, addresses and other contact details;

b- The agreement to arbitrate on which the request is based (an arbitration contract or a contract including an arbitration clause);

c- The contract or the legal act out of which the dispute has arisen or related thereto,

 d- a brief statement of the facts, the legal arguments and the reliefs sought (which includes a preliminary statement of the relief sought, together with the amounts of any quantified claims and, to the extent possible, an estimate of the monetary value of any other claims)

e- The number of arbitrators and the arbitration language if not mentioned in the agreement or the arbitration clause.

f- the claimant’s observations or proposals as to the number of arbitrators, the language, the seat of arbitration and the law or rules of law applicable to the substance of the dispute;

g- if the arbitration agreement provides for three arbitrators, and the parties have not agreed otherwise, the name and contact details of the arbitrator nominated by the claimant;

h- proof of payment of the Filing Fee referred to in Article 42 of the LIAC-BBA rules.

2-Additional information
The claimant’s VAT number, if the claimant is registered for VAT; and email address and mobile telephone number of a legal representative of the respondent. 

3-Payment of the Filing Fee
Upon filing the Request for Arbitration, the claimant shall pay the Filing Fee prescribed in Article 42 of the LIAC-BBA rules. The amount of the Filing Fee payable in connection with a Request for Arbitration or a Counterclaim is 750 United States Dollars.
The filing fees for the claim and the counterclaim are non-refundable.
Payment of the filing fee can be made in cash at the LIAC-BBA.

4-Language of the Request for Arbitration
The Request for Arbitration shall be submitted in the language of the arbitration as agreed by the parties. Failing such agreement, the Request for Arbitration shall be submitted in the language of the arbitration agreement.
